terms and conditions
The terms "we", "us", "our" and "Apex RV Tours refer to Apex RV Tours Inc. The terms "customer", "you", "your", "guest", "the group", "participant" or "tour participant" refers to the customer and all people included in the booking registering for a tour with us.
By booking with us you agree to be bound by these terms and conditions and that you are at least 19 years of age. A customer making a registration for people other than themselves is financially responsible for payment for themselves and everyone else in the group and certify you are legally authorized to act on behalf of the people you represent and accept these terms and conditions on their behalf and acknowledge that you have informed them of these terms and conditions and that they have also read, understand and accept the terms and conditions. You certify that all information you supply us is true, correct, current and information on behalf of everyone in your group is true, correct and current. This agreement affects your legal rights. You agree that it is necessary for us to make changes from time to time and it is your responsibility to check for any changes at apexrvtours.com and those changes will become effective immediately. You agree to the terms and conditions which are in effect at the time of your cancellation or travel. If you do not agree to the terms and conditions then you must not make a booking with us.
It is agreed and understood that the only function of Apex RV Tours is to organize and guide the RV tours. We have no control or financial interest in or any responsibility for any of the Third Parties supplying goods or services to our tours. We are not an agent for nor do we represent any of the suppliers of goods or services we might use on our tours.
Cancellations and Refunds. All reservations made by Apex RV Tours on your behalf are made well in advance of the tour so our policies are unavoidable. All of our suppliers have their own cancellation policies and we can not be held responsible for their actions. Should you need to cancel you must provide a written request, an email sent to email@example.com is sufficient. A deposit of 15% is due within 10 days upon confirmation of your booking. Payment in full must be received at least 90 days before the start of the tour. Bookings made less than 90 days before the start of a tour must be paid in full at the time of the booking. If we do not receive any payment in full and on time then at our sole discretion we reserve the right to treat the booking as cancelled. If you cancel 150 days prior to departure we will refund 100% monies paid less a $100 per person cancellation fee, if you cancel 149 - 90 days prior to departure a cancellation fee of 10% of the full tour price will apply, if you cancel 89 - 60 days prior to departure a cancellation fee of 15% of the full tour price will apply, if you cancel 59 - 30 days prior to departure a cancellation fee of 20% of the full tour price will apply, if you cancel 29 days or less before departure a cancellation fee of 30% will apply, any remaining monies after cancellation fees will be refunded. If a customer attempts to reverse any payment already made without the agreement of Apex RV Tours consent, then we reserve the right to collect all costs and expenses incurred and associated with the chargeback including all without limit legal fees. All applicable credit card and banking fees will be deducted from any refund at our sole discretion. You can not sell or give or in any way transfer your tour to anyone. We reserve the right to cancel any tour or event at any time prior to departure. In the unlikely event this were to occur all payments will be fully refunded except in the case of force majeure. All refunds are made to the original payer and are not transferable. All refunds due will be paid within 30 business days. If it becomes necessary to cancel or alter any aspects of the tour including but not limited to activities, events, routes, campgrounds or prices, then it will be at the sole discretion of Apex RV Tours. Any changes made will try to be made with the customer in mind.
Covid-19 Policy. Covid-19 is highly infectious and is easily spread. It has found its way into many areas around the world. If you are afraid to be infected, are older with underlying medical conditions or in any other way prone to infection then it you should not book a tour with us. It should be assumed the virus could be anywhere and precautions taken. We recommend Covid-19 insurance be purchased. We are following the recommendations and laws where we travel but there are no guarantees it is without risk, everyone must decide for themselves how to make their travel decisions. You acknowledge we have no control over this virus and your tour may be postponed or cancelled. You might become sick during your travel, you might become infected before you arrive for your tour, you agree to not hold us or anyone associated with us liable. You understand the risks and methods of spread concerning Covid-19 are not completely known. You acknowledge that travel or any other restrictions could be imposed at any time forcing us to adapt.
Force Majeure. Apex RV Tours will make no refund for or be held responsible for, events beyond its control of any kind, without limitation, acts of God, natural disasters, war or terrorism or threats of war or terrorism, civil disorder, customer travel or scheduling, delay, cancellation, weather, flood, landslide, injury, death, illness, disease, epidemic, pandemic, quarantine, government restrictions, any Third Party acts or omissions.
Medical. It is the responsibility of all participants to notify Apex RV Tours in writing of any mobility or medical issues when registering for a tour and participate in our tours at their own risk. We reserve the right to refuse participation in any of our tours to anyone with medical conditions which are not compatible with our tours, at our sole discretion. It is understood that there may be instances where there is no wheel chair accessibility or limited access. It is the responsibility of the customer to have someone always with them to help with any mobility needs and must not require special assistance from Apex RV Tours or any Third Party. You understand there are some activities conducted at higher elevations which may exceed 7500 feet which may not be compatible with some people.
Insurance. Apex highly recommends you purchase appropriate medical, travel and trip cancellation or interruption insurance. We can not be held responsible for inadequate insurance. We are not qualified to answer questions about insurance so you must consult with a qualified person.
Conduct. All tour participants are responsible for their own conduct and are free to do as they please and are under no one else's control or direction and any of their actions are entirely their own and are responsible for choosing to take part in any activity or not to take part. Customers are responsible for their behavior, actions, health, unlawful driving or conduct. Tour participants agree to cooperate with everyone else and be on good behavior. All participants understand and agree to the importance of respecting and staying away from any wildlife which may be encountered. All customers agree to hold us harmless for any liabilities to any Third Party for any damages of the customers actions or belongings. We are not responsible for any costs incurred by a guest removed from the tour.
General. Customers are responsible for vehicle insurance, travel insurance, medical insurance, vehicle maintenance, vehicle repairs and operation. Apex is not qualified to answer questions about proper vehicle repairs so the customer must seek answers from qualified people. Customers are responsible for all other expenses not included in the tour. We reserve the right to have the wagon master also perform the duty of tail gunner if any tour has 11 or less participants. We are not responsible for any lost or stolen belongings. If for any reason you need to leave the tour you may rejoin at any time, no refund will be given. Any customer who does not show up or leaves the tour early for any reason forfeits all monies paid. Apex RV Tours is not responsible or liable for any issues which may arise from weather, road conditions, wildlife, pets, insects, food consumption, delays, errors, omissions or actions from other service providers or any other things beyond our control and customers agree to hold harmless Apex RV Tours Inc. and its owners, employees, agents and contractors from any and all liability, damage or loss claims which may result from our caravan tour.
Travel. It is the customers responsibility to arrange and pay for travel to the start of our tour and departing our tour, we assume no responsibility for scheduling of any flights, buses, trains or any other form of travel. Any delays or problems arriving to the start of our tour or departing our tour is not our responsibility and the customer agrees to hold us not liable. It is the responsibility of the customer to be informed about the travel destinations Apex RV Tours offers, including any necessary travel documents, laws or restrictions. We do not represent that the travel to any destination or participation in any activity is safe or without risk or danger. There are many risks associated with travel including but not limited to illness, injury or death. You are aware of any risks and take full responsibility for any and all of your actions on behalf of you and all members of your party including minors and is binding on your heirs, legal representatives and assigns. If you have a pet and arrange for us to monitor or take your pet for a bathroom break, you acknowledge there are risks and we are not liable for any claims. You agree to release Apex RV Tours from any claim which may arise from our tour. If you do not want, or anyone in your party does not want to accept any risk then you should not book any tours with us.
Waiver. You are aware and acknowledge you will be required to sign a Waiver and Hold Harmless Agreement provided to you by Apex RV Tours, before participating in our tour. Failure to sign the Waiver will result in cancellation of your booking and the cancellation policy guidelines will apply.
Photo Policy. While we respect everyone's privacy, as a tourism based business photos and video are an integral part of what we do. We take occasional photos and videos and sometimes our customers are included, if possible we inform the customer if they will be photographed and if they do not want to be included then we will make our best effort to not include them. You consent to the use of your photo and name for promotional purposes and waive your rights under applicable privacy laws for us to get further permission for such use.
Jurisdiction and Law. Our operations are governed by the laws in the Province of Alberta and any claims must be filed in Alberta only.
Severability. If any provision of these terms and conditions are held to be unenforceable, then such provision will be struck and the remaining provisions will remain enforceable.
